TAS5760M: in HW mode, is FRQ/SDA latched on power up?

I'm trying to use it in HW mode for some games and SW for newer games and we don't want two different PCBs.
 The fewer jumpers and dip sws the better.

    In Hardware Control mode, the PWM switching frequency of the TAS5760M is configurable via the FREQ/SDA pin. When connected to the system ground, the pin sets the output switching frequency to 16 × fS. When connected to DVDD through a pull-up resistor, as shown in the Typical Application Circuits, the pin sets the output switching frequency to 8 × fS. The configuration is latched during power-up.
