Use of C6678 EVM as part of a finished product.

Hi everybody,

we have developed a custom board (with FPGA and analog parts) and we are using a TMDSEVM6678L to control it. It is working great and we would like to make a finished product including our custom board and the TMDSEVM6678L, without having to develop a new board for the C6678 DSP. We do not use all the EVM features but we are OK with that. Our concern is that after reading the Standard Terms and Conditions for Evaluation Modules (www.ti.com/.../sszz027j.pdf), we are not sure that we can just use the EVM in our final set-up.
In particular, point 1.1 states that "EVMs shall not be directly or indirectly assembled as a part or subassembly in any finished product."

We are not used to English legal-language so, how should that statement be interpreted?

A) It is illegal to include a TMDSEVM6678L in our finished product.

B) We can include a TMDSEVM6678L in our finished product under our own responsibility and Texas Instruments will not be responsible for any problem that may arise.

C) Any other?

In case we cannot assemble the TMDSEVM6678L "as is" in our product, is there any alternative not involving the design of a new board? We have seen that in Advantech website (www2.advantech.com/.../6678le_download3.aspx) there are gerber files, Bill of materials, etc. So, we understand that it may be possible to build a clone of the EVM (maybe even removing things we do not use). Would it be legal to do so? and, in that case, would the same Terms and Conditions apply to that clone?

Any advise would be really appreciated. Seriously, the TMDSEVM6678L works great just as it is. We would be very happy if we could use it without modifications.

    In my understanding, the EVMs are being sold for development purpose only and shall not be used on any of the customer's finished product. So you may need to choose option C. You can download the EVM design files from Advantech website, customize it based on your requirement and rebuild your own board for your final product.

    Our EVMs are not qualified for use in end-products.  Agency qualifications such as for REACH are not compliant for end-products but only for evaluation units.  All of the design files are available on the Advantech web site and you are welcome to produce your own design based on these.  In fact, Advantech can adapt the design for your production.  However, the PCB must not state that it was produced by TI.
