Minimum duty-cycle on the SM72442

I am using the SM72442 and SM72295 in a 300W solar application based on the circuit in the evaluations board SM3320.

When operates in buck mode with at input of 36V and a output on 14,4V it works fine with the load above 500mA, but at lower load the duty-cycle decreases at it shall, but the minimum duty-cycle is limited to 15% by the SM72442!

This result in no output regulation at no load and the output voltage will increase to a value set by the minimum duty-cycle of 15% and the input voltage!

This are measured with no battery connected to the output, but a normal load is connected instead. With the battery connected the problem will occur at the charge cycle where we switch to standby charge, where we have a no load situation!

The question is what is setting the minimum duty-cycle of the SM72442 and how can I adjust this?

I see the same problem on the TI-evaluation board!
