Can the ADS5560 sample rate go a bit higher than 40 MSps?

The ADS5560 is a 1 to 40 MSps ADC. Page 9 of SLWS207B states that the max "recommended operation conditions" for a clock input is 40 MSps. However, I need to synchronize this to an external clock whose frequency I cannot tune, and its frequency is ~40.05 MHz (definitely less than 40.1 MHz, but definitely above 40.0 MHz). Can I feed the ~40.05 MHz clock into the ADS5560 and have it sample at the same clock frequency, i.e. sample at ~40.05 MSps? I understand that one alternative is to get the ADS5562 that can range between 1 and 80 MSps, but the ENOB of that converter is slightly lower and high ENOB is very important.

    Normally when asked if a device can operate outside of its datasheet limits I have to say that such operation is not guaranteed because the production test program would not be testing the device for operation outside the max spec limits.    But I doubt that there would be any issue with operating a 40Msps device at 40.1Msps.  The devices would have been tested at 40.0Mhz, and I would not expect to see a device pass at 40MHz and fail at 40.1M.
