ADS1209: Question about setting sinc filter

Please let me know about three points below for ADS1209 setting sinc filter;

①Is ADS1209 need to use 3rd order sinc filter?

②Is there calculation or simulation tool for sinc filter?

③Customer spec is below, is it no problem?

 ⇒Output side of ADS1209 is FPGA, Input frequency: 4kHz, Sample rate: 40ksps

    The short answer to your question is no, the ADS1209 does not have to use SINC3 filter. However, the performance characteristics described in the datasheet are based on using the ADS1209 with a SINC3 filter and oversampling ratio (OSR) of 256. There are trade-offs between accuracy and speed of the filter that depend on the filter order and OSR. This is shown to some extent in Figures 28 and 28 of the ADS1209 datasheet and Figure 14 in the AMC1210 datasheet. We do not have a simulation tool or calculator for the SINC filter, but this application note does a good job of showing the frequency response of various SINC filters: www.ti.com/.../sbaa230.pdf
