I am sorry but your answer raises concerns :

When the manufacturer applies CE to their products they have the obligation to draw the CE/EU Declaration of Conformity.

Mouser USA as the importer when selling the product on behalf of TI in the EU, we, Mouser USA, also have the obligation to hold in our records a copy of TI's CE/EU Declaration of Conformity.

In other words, it is illegal for T.I. to apply CE to a product without having the technical file and the CE/EU Declaration of Conformity supporting the CE mark.

And Mouser USA has the obligation to to hold a copy of the EU Declaration of Conformity for all CE-marked products we offer to the EU - Obligations also dedicated by the CE directives (ROHS included)

The legal obligations put on the manufacturer  (and the importer) with regards to the CE/EU Declaration of Conformity are explained in all the CE Directive, including the ROHS 2011/65/EU (Access HERE)

They are also explained in great length in the EU Blue Guide (The general guidance on CE issued by the European Commission) access HERE

EU Declaration of Conformity are mandatory for all products the manufacturer decides to CE mark.

In addition, and also explained in the CE Directives and the EU Blue guide, the manufacturer (and the importer) must keep the CE/EU Declaration of Conformity for 10 years after last sale.

As the product is still active, now that you highlighted the CE/EU Declaration is missing, T.I needs to either correct this breach by drawing the CE/EU Declaration now; or.... if T.I has no evidence to support the CE claim, TI must stop to CE mark this product (and please advise Mouser equally as this would consequently mean the product is not suitable to be placed on the EU market.

I let you review internally the CE compliance information  for this product and either issue a request to have the CE/EU Declaration of Conformity drawn and provide it to us; or let us know if the product does not meet current CE compliance requirements (in which case, TI shall to stop applying CE to the product going forward)

Hi Nasser, I received the file you emailed, thank you however this is not what we are asking. We need the CE/EU Declaration of Conformity, this is the document required by the CE directives and that engages the responsibility of the Manufacturer. See similar document for a similar product:

Because T.I. manufactures the board with the CE mark we need the CE/EU Declaration of Conformity.

You see the CE mark on the board on the product - see the image from here: https://www.ti.com/tool/DSLVDS1047-1048EVM?keyMatch=DSLVDS1047-1048EVM.

If the product is not CE compliant, this would mean T.I. should not print CE on the product. And equally, this would mean the product is not suitable for the EU market.

If you have the technical file that confirms the board is compliant, all that would be missing is the CE/EU Declaration of Conformity.

I gave you the example SKU DSLVDS1001-1002EVM See T.I CE/EU Declaration of Conformity click HERE 

This is exactly the document we need for DSLVDS1047-1048EVM.

You would need to make an internal request to get the CE/EU Declaration of Conformity issued. I know this can be done because I had encountered other CE-marked products with TI that were missing the document and that was drawn afterwards.

To resume: Is the board CE-compliant?

If YES, we need the CE/EU Declaration (you would need to put an internal request to get the document drawn)

If NO, we will need a formal confirmation from T.I. as we still have stock. You would also need to geT.I..I to stop adding the CE mark on the product, and the product will not be suitable to be sold to the EU and UK markets.

ok if the board is not CE compliant anymore, please can you send a formal communication to EnvironmentalCompliance@mouser.com so that we keep that in our record and update the restriction of the parts in our system. We will also need confirmation that T.I will not apply the CE mark on the product going forward.
