    Chen,

    VIO must be connected to the supply rail of the logic signals so that the device has a reference for the logic pins. If you do not need this pin, please consider TCAN1044A-Q1, which has an electrical no-connect for pin 5.

    The VIO pin can be anything from 1.7 V to 5.5 V, so you can connect the same VCC that your microcontroller is using.

    If by "not in use," you mean when the system is unpowered, then you can see the operation of the device in the section titled "9.3.6 Undervoltage Lockout" in the data sheet.
