DP83869HM: repeater mode and datasheet and application note differences

Hi,

we are about to start a project that requires a copper to copper/fiber interface (as in a repeater but with the option on one end for either copper of fiber interface). The DP83869HM looks like a good candidate for this (two DP83869HM connected back to back via RGMII, one in fixed mode RGMII to copper mode and the other in managed mode - RGMII to copper or fiber). We have a couple of questions:

1) Is our assumption correct that two DP83869HM can be connected back to back via RGMII?

2) Regarding the fixed mode one (RGMII to copper), we noticed there is a difference between the datasheet SNLS614A and app note SNLA318. According to both, OPMODE_0, OPMODE_1 and OPMODE_2 need be set to 0. In order to do this, datasheet SNLS614A (p.44-45) requires pins 22, 36 and 35 be pulled down via a 2.49K (as per table 10 - 2-Level Strap Resistor Ratio), whereas app note SNLA318 (p.2) shows those pins as OPEN. Which of the two would you advise to follow?
