TPS709: EN floating issue - not working

Hello,

I'm using a TPS70933DBVR with the suggested layout. Pin 3 (EN) is left floating. When I apply 8 V to Vin the LDO stays disabled. It is the same with higher and lower voltages. 

When I connect the probe of the oscilloscope to the EN pin, the regulator gets active and seems to be working as intended. I can't measure what's happening when the LDO stays disabled. I tried 6 different devices from the same batch on 2 different boards (one board is populated with a microcontroller and the other board is equipped with the LDO alone). The fault is always the same. I also modified one chip and removed the EN pin before soldering - same behaviour.

For testing I soldered a 68 nF MLCC from EN pin to GND. The regulator stays off until I briefly connect the probe or touch the EN pin. After that it stays on for quite some time (~ hours). Do I have a faulty batch? Is there a problem with the 300 nA current source?

Unfortunately I can't find new devices in stock for comparing/ testing.
