ATL431LI: operating voltage on cathode close to abs max

Part Number: ATL431LI

The operating voltage on the cathode ofVref up to 36V. The absolute max rating is very close at 37V. Customer is using component in an overvoltage protection circuit that clamps at 36V. At fast transiens the voltage could shoot to 36.4V. Should customer be concerned? thx.
