TPS54201: Driving a Peltier Element Application Note

I am designing a circuit for driving a Peltier Element, I noticed a difference in the datasheet schematic for the TPS54201 and the schematic given in the "Driving a Peltier Element (TEC): Efficiency and Aging" Application note. Namely, I am unsure why the ground pin of the Peltier Element is connected to ground (As shown on the application note schematic) and not back through the RC filter into the feedback pin (As shown in the TPS54201 datasheet schematics)?
