bq2002g - Sometimes no PVD termination

I built a circuit based on the bq2002g with a LM317 as constant current source. I want to charge a 600 mAh NiMH battery with a aurrent of C/2, so 300 mA. Now I have got the problem that the PVD based termination sometimes does not work, so the charging is going on although the battery is full (and of course then the battery is getting hot). If I measure the voltage at the battery with an ascilloscope I can see that the voltage is getting lower, so actually I can see the peak voltage criteria. Can you give me a hint what the problem could be??

    I've got one more question: How is the PVD defined exactly? Is it a decrease of 2.5mV from maximum measured voltage ever, or is it a decrease of 2.5mV from one measurement to the next (what would be around 17 sec.).
