BQ2002 and replacement for the LM317

I am using the USB 5V to charge 3 NiMH batteries in series. The LM317 has a rather large dropout voltage and there are many new LDO regulators that reduce the dropout voltage to as low as 300mV at 1A. I used the recommended design for the BQ2002T and replaced the LM317 with the TL1963A. It appears that the TL1963A does not like to operate as a constant current source. It also appears that the CC output does not affect the TL1963A the same as the LM317.

Can the TL1963A act as a constant current source?

Can the TL1963A be controlled the same as the LM317 using the CC and a transistor follower? See schematic below.
