And the ti-dvsdk_dm365-evm_4_02_00_06 which you can get here: www.ti.com/.../linuxdvsdk-dm36x
It uses the Linux kernel version 2.6.32-17

As you see the kernel version is different - 2.6.32 in dvsdk4.0.1 and 2.6.37 in dvsdk4.0.3
There are applied some patches in the last dvsdk version.The dvsdk4.0.3 officially does not supports OMAP35x processors.

Without fully knowing your end application and use case, I can only suggest, as a start, to look at the dm368 product. It does have a supported SDK that supports H.264 encode @ 1080P HD.
Both BP and MP are supported. The encoder is royality free.
