Why must you pull open drain to VA for ADC121C021?



For the Alert, SCL and SDA pins the pin description table states; ‘This is an open drain data line that must be pulled to the supply (VA) with an external pull-up resistor.’. We have a VA of 5V but the alert pin will interface to a 3.3V device. My question is that if it is an open drain I would have thought you could pull it up to any voltage, why does the data sheet say you ‘must’ pull up to VA?
