Please note that thermal shutdown is a protection feature to protect the device if its junction temperature exceeds its maximum rating. Hence, thermal shutdown threshold has to be set outside the operating range.
It is expected that the device is always operated under its maximum junction temperature for normal operation and occasionally if there is a fault in the system that causes the junction temperature to exceed its maximum rating, then the thermal shutdown feature can protect the device and avoid any damage. Such use of device is not an issue and you shouldn't have any problems.
