UCC28780EVM-021: CE/EU Declaration of Conformity (aka EU DoC) required

Thank you for sharing the EU DoC for UCC28780EVM-003, unfortunately, this does not solve the issue.

If the intent was for the EU DoC to apply to UCC28780EVM-021 as well as UCC28780EVM-003, the document should clearly refer to both parts. 

Not having a CE/EU Declaration of Conformity covering UCC28780EVM-003 is a breach of compliance per the CE directives.

As UCC28780EVM-021 is CE marked, the manufacturer must draw the EU Declaration of Conformity engaging their sole responsibility and confirming the product is meeting the CE compliance. This is a legal requirement expressed in all the CE directives, the ROHS Directive 2011/65/EU included.

Please refer to Article 7.c of the ROHS Directive 2011/65/EU under Obligations of the Manufacturers: "Where compliance of EEE with the applicable requirements has been demonstrated by the procedure referred to in point (b), manufacturers draw up an EU declaration of conformity and affix the CE marking on the finished product.../..."

And, also,  Article 7.d of the same directive, also under Obligations of the Manufacturer "manufacturers keep the technical documentation and the EU declaration of conformity for 10 years after the EEE has been placed on the market"

The reason we are asking for the CE/EU Declaration of Conformity is that we have purchased this product from T.I and are offering it to the EU market, and when Mouser USA sells the product to the EU, Mouser USA is the importer of records.

Under the Obligations of the Importer, we, Mouser USA, must hold a copy of the CE/EU Declaration of Conformity for the products we place on the EU market, and keep it in our records for 10 years after the last sale. (Cf Art. 9.g of the ROHS directive).

We have stock of the product UCC28780EVM-021 and it has been highlighted that we do not have the CE/EU Declaration of Conformity for this part.

We are therefore calling on your support to resolve this compliance concern. Please provide the CE/EU Declaration of Conformity covering this product.

Last update was 3 weeks ago when you advised the CE/EU Declaration of Conformity would be provided the following week.

We are unable to locate the original document, but in case you are looking for CE marking we have this on the EVM. 

Please let me know if the above works. We have initiated the process of reapplying for the certificate but it will take a few weeks.

We know the product is CE-marked, and this is the reason we are asking for the CE/EU Declaration of Conformity.

When a manufacturer (here Texas Instruments) applies the CE-mark to their product they have the obligation to draw the CE/EU Declaration of Conformity.

They must also keep this document in their records, along with their technical file for 10 years from the last sales.

These are legal obligations, dictated by the CE Directives - for example, please refer to CE Directive ROHS 2011/65/EU, Article 7.c under Obligation of the Manufacturer. (Access to the ROHS directive HERE) - and extract below:

"c. Where compliance of EEE with the applicable requirements has been demonstrated by the procedure referred to in point (b), manufacturers draw up an EU declaration of conformity and affix the CE marking on the finished product. Where other applicable Union legislation requires the application of a conformity assessment procedure which is at least as stringent, compliance with the requirements of Article 4(1) of this Directive may be demonstrated within the context of that procedure. A single technical documentation may be drawn up;"

Mouser USA is the importer of records when selling the product on behalf of Texas Instrument to the EU, and the CE directive dictates that the importer must hold in their records the copy of the CE/EU Declaration of Conformity of the CE products they offer to the EU.

We are currently offering this product to the EU markets, to continue offering the product to the EU and meet the CE compliance requirement upon us, we need a copy of the CE/EU Declaration of Conformity. Hence the request.

I appreciate you may have not been able to find the "original" declaration, but we do need T.I. to provide us with the CE/EU Declaration of Conformity to justify the CE mark on their product.

I am concerned the request is a month old already - How long do you need to provide this, please?

I am sorry to chase again, however, the request for the CE compliance status was raised two months ago and in our last exchange you were going to provide an update the following week but I have not heard back from you.
Please kindly advise:

Is UCC28780EVM-021 CE certified/CE marked? [YES/NO]

If YES, T.I must provide the CE/EU Declaration of Conformity.

If NO, I will understand the product is not currently suitable for the EU/UK market, unless T.I advises the product is somehow out of the scope of CE marking/certification requirement.
