The gate pin will start to operate if PWM is high and as soon as you have Vin above the threshold of 6.5V and after soft-start timing.

The GATE pin is being activated even with the IADJ pin at level 0.
Below is an image of the circuit.
We assembled 200 pieces and 25 pieces presented this problem.

We can only guarantee current control of IADJ from 140mV to 2.25V. So what you are seeing is correct. There will be parts that will switch because of offset in the system controlling with IADJ below the 140mV specified in the specification.
The only way proper way to disable the part from switching is pulling down the SS pin with an open collector/Drain of a transistor.
