bq24115 stat 1/sleep mode

I am building a 3 cell lithium battery charger using the bq24115.  I've used the typical setup with the following values.

R.sence=.1 ohm

R.set1= 10k ohm

R.set2= 5k ohm

V.in= 13V

V.out=11.9V

My problem is that according to the data sheet (table 1) the stat1 led should be off when there is no battery connected to the circuit.  In my circuit as well as the evm I got from ti, the stat 1 led remains lit all the time. It also does not enter sleep mode if I attach a fully charged battery. V.bat >= V.out.  Sleep mode should also result in stat 1 led extinguishing. 

I do however see a constant voltage on the output terminals even without a battery connected which I believe should not be happening while there is no battery present. 

I also can not verify that switch mode is occurring when charging a battery where V.bat < V.out.  Which I think may be because of this bug.

What do you think is causing this and what can I try to fix it.
