About SLVA540: EN level-shifting control Circuitry for an Inverting Buck-Boost

I have just read the Application Note SVLA540 (Level-Shifting Control foran Inverting Buck-Boost) and I have a couple of questions about the EN level-shifting control Circuitry:

-How do you assure that Q2 will operate in saturation region with both scenarios (Vout=0V and Vout=-12V)?

-Could have been used MOS transistors (NMOS for 1 and PMOS for Q2) instead of bipolar?

If the answer to the last question is yes: What are the adventages of using bipolar transistor against MOSFET transistor for this circuit?
