TMAG5110-Q1: Inquiry Regarding Scope of Warranty Disclaimer in Datasheet’s IMPORTANT NOTICE AND DISCLAIMER

Dear Team,

We have received a question from our customer regarding the “IMPORTANT NOTICE AND DISCLAIMER” section found at the end of TI’s datasheets. Specifically, they would like to clarify whether the warranty disclaimer applies to the entire contents of the datasheet, including the specification-related sections, or if it is limited to general design resources and guidance.

The customer wishes to confirm that the disclaimer does not imply a lack of warranty for the technical specifications (such as electrical characteristics, mechanical data, etc.) described in the datasheet. Their understanding is that TI continues to warrant the accuracy of specification-related content under TI’s standard product warranty.

Could you kindly confirm whether the disclaimer at the end of the datasheet applies to the specification sections as well, or if those remain covered by TI’s standard warranty terms?

    Thank you for your previous response referring us to Section 8 of the Terms regarding Warranties and Related Remedies.

    However, we would like to kindly request further clarification, as it remains unclear whether the specifications published in the product datasheet are explicitly covered under TI’s warranty.

    Our customer is specifically concerned about whether the performance parameters listed in the datasheet are guaranteed as part of the warranted functionality of the product. While we understand that TI provides technical resources “as is” and with all faults, we would appreciate a clear statement on the following:

    Does TI warrant that the product will meet the specifications listed in the datasheet under normal and proper use, within the warranty period?

    A definitive answer would greatly help us and our customer in evaluating the product for critical applications.

    My understanding of item (i) shown at the beginning of section 8 is that the specifications are warranted and that the special notice in the datasheet does not void this warranty.  This is only true only under the conditions set forth by those terms. Items (a), (b), (c), and (d) define conditions where this warranty is no longer considered valid.

    "TI warrants to Buyer that each (i) Product conforms to TI's published specifications for such product for a period of twelve (12) months after the date TI or an TI-authorized distributor delivers such product..."
