The thermal resistance of 0.38C/W is applicable based on the JEDEC define 1S0P PCB and the thermal vias etc. used in the TI design. This may be different on the different system with different level of heat sinking.

Yes the internal temperature sensors can be used to roughly estimate the Tj. You can use the average of the Rx and Tx temperature sensor readings.
Note that the accuracy of the internal temperature sensor is about 7deg.
