Still back to the frequency range, with Nom 40 MHz and Max 30 Mhz: To my mind this line with Tmin < Ta < Tmax just refer to the operational temperature? So this will also exclude a nominal frequency of 40 MHz, right?

Yes, you are right. We have verified that the device will always work with a 30MHz clock frequency across the entire operating temperature range. 40MHz will work at 25C typical, but not guaranteed to work across all the entire temperature range.
Nominal and typical are equivalent terms in this context. The same is true for our typical specs in the electrical characteristics table as well.
The 12-bit datasheet makes a little more sense with the way they split up the line items:
