Hi Andrew,
This is determined based on the maximum number of consecutive dominant bits possible in a CAN signal: 5 dominant bits followed by and error frame (6 dominant bits). The minimum data rate is then determined based on these eleven bits taking up the entire DTO time. Min rate = 11bits / 1.2ms ~= 10kbps. There's a short note in the datasheet describing this estimation as well in Section 9.3.1.
