Are you setting the PHY in "Testmode 1" when doing the compliance testing? Please see below for the register command

Write TM1 single channel:
=> mii write 0 0x00 0040 -> 1000Base-T
=> mii write 0 0x10 5008 -> forced MDI
=> mii write 0 0x09 3b00 -> Test mode 1
=> mii write 0 0x0d 001f -> Write extended addressing
=> mii write 0 0x0e 0025 -> Register to write
=> mii write 0 0x0d 401f -> Write extended addressing
=> mii write 0 0x0e 0400 -> Output test mode to channel A
Measurement Run 1 is performed.

Compliance testing is performed by switching between Testmode 1 to 4.

I provided my layout review response. Reg 0xA0, 0xA1, 0xA2, 0xA3 can help in adjusting signal amplitude per channel. Please experiment with these fields accordingly to see if they help in these compliance tests.
