TCAN4550: CANFD bit rate - 5Mbps or 8 Mbps?

As the title suggests, is the bitrate 5 Mbps or 8 Mbps? The datasheet shows both numbers(view image below) and is not conclusive. If the bitrate is 5, I would like why 5 is the constraint?image (1).png

    You need a minimum of 5 time quanta (tq) per CAN bit, and the maximum supported clock frequency is 40MHz.  

    40MHz / 8Mbps = 5 tq, which is the absolute minimum tq needed to create a CAN bit.

    40MHz / 5Mbps = 8 tq, which gives you 3 extra tq to adjust the sample point location and account for oscillator tolerance variation.

    When the device was developed, 5Mbps was the max rate that had any timing or performance specs associated with the standard even though technically 8Mbps could be supported theoretically if the bus  was ideal and the clock sources for all nodes on the bus were almost perfectly matched and met the most stringent clock timing requirements.
