[TUSB1210] Should short VBAT pin to VDD33 pin?

I received a question from a customer.

The customer's power source voltage is 3.3V (typ).  When the 3.3V is provided to VBAT and the USB2.0 certification is required, should VBAT be shorted to VDD33?

If VBAT is not shorted to VDD33, the customer would not get the USB2.0 certification because the voltage drop due to the internal LDO would affect output DC level on D+. So I think VBAT should be shorted to VDD33. Please let me confirm whether my understanding is correct.
