SN65HVD1040: Whether pin 5 can be floated when using split termination

Hi,

Our customer wants to use SN65HVD1040/SN65HVD1050 to replace NXP's TJA1050T/VM.

They are utilizing split termination structure but the current layout will not use the function of Pin 5 to provide a ref voltage. 

I have seen the previous E2E answers as, 

"The SPLIT pin function is to drive the common-mode recessive level on the CAN bus, as a means to stabilize this level, helping with any minor deviations. The main purpose for this is to help with any electromagnetic noise the device may emit during operation. The TCAN1042 and other devices in our TCAN family have been improved in several ways, one of them being electromagnetic compliance, and are able to pass certification for emissions without the SPLIT pin. This has driven the decision to not include the SPLIT pin on our future devices."

So the question is, is there any problem if they use SN65HVD1040 and SN65HVD1050 but left Pin 5 floated? Thanks.
