MSP432E411Y: Question to License of some files in MSP432E simplelink SDK

Hi,

we have a problem with the license of the TI MSP432 SDK. Some files have an additional sentence:

"You may not combine this software with "viral" open-source software in order to form a larger program."

This sentence makes our legal to not allow us to use it as OSS.

 So I have two questions:

1. Is this sentence a mistake and can be removed? (asked from legal)
2. Alternatively to OSS is it possible to get an EULA for the code. The we can use it as non OSS.
