Is there in TI some device like MAX038? I need voltage or spi tunable audio oscilator, max038 vas good, bud is no longer available.

I am unfortunately not aware of a direct MAX038 replacement. You may possibly look at a crystal oscillator vendor? TI has some application note on generating an audio clock - see if this is of any help:
