    First of all, I believe you mean TCA9406. TI does not offer a PCA9406 device.

    [Q1] Yes, the device can support your proposed circuit. See page 9 of the datasheet: "One advantage of the TCA9406 translator is that either power supply can be ramped up first. Another advantage is that either power supply can be set to 0 V, and the outputs are in high-impedance state."

    [Q2] Footnote 3 is only applicable when both VCCA and VCCB are powered. I would suggest following the suggested design for the OE pin, also from page 9 of the datasheet: "A pulldown resistor tying OE to ground should be used to ensure that bus contention, excessive currents, or oscillations do not occur during power up and power down"
