LM3102 issue - AGND to NC die short?

I have a project that uses LM3102 converter, we have ordered about 25 chips in TTSOP package for prototypes batch and have found an interesting issue.

It seems that for some of the chips pin 7 (AGND) is shorted with NC pin 9 (NC). This problem was noticed when we were inspecting the PCB after soldering LM3102, to check whether anything was shorted. After we found the same problem (always pin 9 was shorted to the ground) on different PCBs we suspected it was not the problem of soldering (as thought first), but something else.

We checked bare laying LM3102 chips and it turns out some of them have this short, others dont.

I think about 7 out of 25 had this issue but I am not sure exactly. Obviously this is very strange stuff going on here. Therefore I am asking you, Texas Instruments, what is going on, how that happened, and most of all does it affect the performance of the chip in any way.

So far we have only soldered chips without the short, leaving the rest out of the prototypes.

Chips were ordered from Mouser through local distributor, chip version was LM3102MHX-NOPB.
