DS250DF810: SMBus mode select

I'm trying to use the DS250DF810 in SMBus mode.

PIN12 is used for mode selection and it is connected to GND with 1kΩ.

Question
Does this IC operate as SMBus immediately after booting?
Or does it act as an SPI immediately after booting and switch to SMBus mode after a certain amount of time?

In the latter case.
How long does it take to switch to SMBus after booting?

    Upon power-up, the retimer will go through a power-on reset cycle. The typical POR cycle time is 50ms. As per the datasheet, "Internal power-on reset (PoR) stretch between stable power supply and de-assertion of internal PoR. The SMBus address is latched on the completion of the PoR stretch, and SMBus accesses are permitted." During this 50ms cycle the retimer will not respond to SMBus operations.
